TERMS
Terms of Use
These Terms of Use ("Terms") set out the conditions for booking and joining experiences on trapol.jp (the "Site"), operated by TRAPOL Co., Ltd. ("we" or "us"). By applying for a booking on the Site, you ("you" or the "guest") agree to these Terms, the cancellation policy of the experience and our Privacy Policy, and these Terms form part of the contract between you and us.
Article 1 (Scope)
- These Terms apply to bookings of experiences made on the Site ("bookings") and to joining those experiences.
- The conditions shown on each experience page, in the booking form and in the booking confirmation email (price, date and time, meeting point, requirements, cancellation policy and so on) form part of these Terms. Where the price, date and time, meeting point, requirements or cancellation fees in those conditions differ from these Terms, those conditions prevail.
- Bookings made through other booking sites ("OTAs") are governed by that OTA's terms and conditions for booking, payment and cancellation. Bookings taken by phone are paid at the venue on the day. If you call us before the start time to cancel a phone booking, no cancellation fee is charged.
- Products we sell as travel contracts under the Travel Agency Act are governed by the travel conditions for that product and our travel agency terms, which prevail over these Terms.
Article 2 (Making a booking)
- You apply for a booking by entering the required details in the booking form and choosing a payment method.
- After you apply, we send a verification code to the email address you entered. The booking is made when you enter the code and the payment is completed. We confirm the booking on screen and by email.
- If the code is not entered and the payment not completed within 10 minutes of applying, the application is cancelled and the reserved seats and the hold on your card are released. Depending on your card issuer, it may take some days before the released hold shows on your statement.
Article 3 (When we may decline a booking)
We may decline an application, or cancel a booking already made, in any of the following cases. We then refund the full amount received.
- The details entered are false, wrong or incomplete.
- Someone else's name or payment method is used without permission.
- We judge that the booking is intended for resale.
- We otherwise reasonably judge that accepting the booking is not appropriate.
Article 4 (Your details)
- You book on behalf of all participants as the lead booker, and you agree to share these Terms and the requirements with every participant.
- Enter your name in Roman letters as it appears on your passport, and an email address you can reliably receive. Unless we are at fault, we are not responsible for any disadvantage caused by our messages not reaching you because of an error in what you entered.
- If you are a minor, get the consent of a parent or guardian before booking.
Article 5 (Price and payment)
- The price is the amount shown on the booking page of each experience, in Japanese yen and including consumption tax. Costs not included in the price, such as travel to the venue, are yours to pay.
- You can pay by the methods shown in the booking form (credit card, Apple Pay and Google Pay).
- We place a hold on your card when you apply, and charge it when the booking is made.
- You can use one coupon per booking. Each coupon follows its own conditions.
Article 6 (Changing a booking)
You cannot change the date, time or number of guests of a booking online. To ask for a change, use our contact form. If we cannot make the change, please cancel the booking and book again. Cancellation fees under Article 7 apply.
Article 7 (Cancellation by you)
- You can cancel a booking on the booking page linked in your confirmation email until the experience starts. After the start time, please use our contact form.
- The cancellation fee is the higher of the amount set by the experience's cancellation policy and 5% of the booking price after discounts (rounded down to the yen). The 5% covers payment fees that are not returned on refunds and our handling costs. The fee tiers are shown in the booking form and the confirmation email, and examples and how to cancel are in our Cancellation Policy.
- If you do not join without cancelling, we do not refund the price.
- Refunds go back to the payment method you used. Depending on your card issuer, it may take some time before a refund shows on your statement.
Article 8 (Cancellation or changes by us)
- We may cancel an experience or change its content because of weather, disasters, venue closures, outbreaks of infectious disease, equipment failure, or anything else that makes it hard to run safely.
- If we cancel an experience, we refund the full amount received. The same applies if you do not accept a change and cancel the booking.
- Apart from that refund, we do not cover costs you paid for the experience, such as travel or accommodation. However, if the cancellation is our fault, we compensate you under Article 14.
Article 9 (Requirements)
- Each experience page shows its requirements, such as age, health, clothing and what to bring. Participants must meet them.
- If you have a medical condition, are pregnant, or are unsure about your health, ask a doctor before deciding to join. Take particular care with experiences that involve heat or physical activity.
Article 10 (When we may refuse participation)
We may refuse participation if we reasonably judge that any of the following applies. We then do not refund the price, unless the reason for refusal is our fault.
- The participant does not meet the requirements.
- The participant cannot take part safely, for example because they have been drinking or feel seriously unwell.
- The participant arrives too late for the experience to run.
- The participant does not follow the instructions of our staff.
Article 11 (On the day)
Participants must follow the instructions of our staff and the venue, and the venue rules. A participant who intentionally or negligently causes damage to the venue, its equipment or other participants is liable for that damage.
Article 12 (Prohibited conduct)
You must not:
- book with false information;
- resell a booking, or book in order to resell it;
- interfere with the operation of the Site (for example, unauthorized access or a large number of applications in a short time);
- disturb other participants, our staff or others, or infringe their rights; or
- break the law or act against public order and morals.
Article 13 (Reviews)
- Guests who booked on the Site can post one review per booking from the booking page after the experience ends.
- We check reviews before publishing them on the Site, and show the reviewer's name as initials. We may decline to publish, or remove, reviews that break these Terms, infringe others' rights, or are unrelated to the experience.
- You allow us to use your review free of charge to publish it on the Site, including translating it, showing excerpts and including your rating in averages, and you agree not to assert moral rights against us.
Article 14 (Liability)
- If you suffer damage for which we are at fault, we compensate you for it. Except in cases of our intent or gross negligence, our liability is limited to the price of the booking that gave rise to the damage.
- The limit in the preceding paragraph does not apply to damage arising from death or bodily injury.
- Unless we are at fault, we are not responsible for loss, theft or damage of your belongings.
Article 15 (Local friends)
Messages to the local friends introduced on the Site go directly to them. Any later exchanges or arrangements are between you and the local friend, and we are not a party to them.
Article 16 (Personal information)
We handle your personal information in accordance with our Privacy Policy.
Article 17 (Changes to these Terms)
- We may change these Terms under Article 548-4 of the Civil Code of Japan.
- Before a change takes effect, we announce the new Terms and the date they take effect on the Site.
- The changed Terms apply to bookings applied for on or after the date they take effect.
Article 18 (Governing law and jurisdiction)
These Terms are governed by the laws of Japan. The Osaka District Court has exclusive jurisdiction in the first instance over any dispute about these Terms or a booking.
Article 19 (Language)
The Japanese version of these Terms is the original. If a translation differs from the Japanese version, the Japanese version prevails.
